I have two tenants who rent my property ( periodic tenancy agreement). The have split up and one tenant has moved out. On 20th Feb they gave notice, stating rental payment has been made to 15th March and this will be their end contract end date. I had initially thought the end date should be 20th March ( I months notice). However, the contract states ‘The Tenant must give notice of no less than one month, such notice to expire the day before a Rent Payment Day or on the final day of the Initial Term’
I am confused as to when the end date should be , and whether this should be 20th March or 14th April.
As Karl says, your legal right is to insist on an end date of 14th April but as a landlord I try to be as sympathetic as I can be and splitting up is already difficult enough so I’d let them leave with a months notice. Whether I then request the additional 5 days rent from them from 15th March to 20th would depend entirely on how they’ve been at tenants really but entirely your call.
Thanks very much for the advice. Ive now agreed the end date to be 20th March, which seems fair. One tenant will be remaining and therefore I will set up a new contract for them on 21st March (with a payment date being 21st). The payment date for the existing tenancy is 15th Month. Would I be correct in thinking that on 15th March they should pay me for 15th March - 20th March? If so, how should this be calculated? Is it the monthly rental divided by 31, multiplied by 6?
