Would you start eviction

We have a tenant moved in back in May, just recently we have noticed someone other than the tenant coming and going on a daily basis.
Last week the tenants mother approached us and explained there was mold on the furniture (not provided by us) we asked if we may enter to check it out.
As there was no mold on the walls no signs of damp on walls or carpets we suggested that it was maybe due to the tenant drying his laundry on an airer inside. We offered for him to use our garden (next door) which was refused. Then suggested he finds an alternate way of drying the laundry.
Things got very heated, we approached the subject of someone living there without permission to find he was hiding in the bathroom.
They demanded a damp survey done, my partner suggested they deal with the illegal tenant before we do anything.
The man still comes and goes for about 4 weeks now tenant is also living there and today no rent has been paid we thought this may happen but unsure how to deal with it.
It was 12 months tenancy but had a 6 month break clause.
Really just seeking advice on how others would deal with it.

S21 Start eviction right away . It will not get better

The mould and damp is irrelevant if someone is there that shouldnt be thats a breach of TA and more importantly trust (and if you live next door sheer stupidity to think you wouldnt.notice) start eviction

These excuses will increase as a get out clause to avoid rent and sublet
S21 before it’s removed and s8 if they miss next months rent

If they havent put anything in writing to you about the mold then it shouldnt be a barrier to s21. However, I would suggest you get a damp survey to cover yourself.

It never gets better. Act now - serve an eviction notice.

Agree --they are in beach of the tenancy agreement by having someone living there who is not on the tenancy agreement so serve Section 21 and Section 8 to evict by tracked and registered first class post.
No if it starts off bad then it only gets worse–also your tenancy agreement should specify that they must ensure adequate ventilation at all times- check and draw their attention to these clauses in writing and send to them at the same time. Good luck Jill

Serve notices as advised in contract clause
If serving by post serve regular first class mail on two consecutive days with proof of postage from post office ( ask post office when posting for stamp and receipt of proof of postage ) or by hand with newspaper or email of contract permits

Send twice. Dog can’t eat it twice!
Don’t send signed for . If they don’t sign out of malice your notice never got served and it will be a get out of jail free card for them
