2 rooms let. ? HMO for council tax purposes

Hi. We let just two rooms individually in a flat so not a registered HMO and we pay the CT. The LA insist we put the CT in the names of the occupants. Our contract states all bills included. Seems like a lot of hassle for us and the tenants. I believe that the property can still be classed as HMO for CT although not large enough to be registered HMO.
Has anyone had a similar situation and can offer advice please?

I always put council tax in tenants name

I believe that you are correct that its a CT HMO but not a housing legislation HMO and you are liable for the CT. Id suggest you educate your Council.
