Agreemnet with friend in 2nd room

H, i have not yet signed a new contract, my to be tenant (husband &wife), want to share my two bedroom flat, with a friend who is willing to use the second bedroom, who is on a Post study work visa, do i have to do an HMO for this?

if so how easy it is to make an HMO? how long does it take? and is it worth doing it? or just decline the tenant? please advise

It would be an HMO from day one and youd have to follow all the HMO Management Regulations and probably a Fire Risk Assessment. I dont think it would need a licence, but you should check with the Council. However, there is a Bournemouth-wide Article 4 directive in place meaning that youd need planning consent to operate an HMO and I believe most applications are refused.

just a thought, In that case i presume i cannot give it out to two students also who want to share the place? without an HMO

Two people are fine. That doesnt make an HMO. However, if they moved in a third person it would immediately become an HMO and a lot of the problems would back fire on you. No reason to suppose they would do that though, so If youre happy with the people then no problem.

what if they moved in a third person and I as a lanlord m not aware of this?

Also i got another inquiry Two working girl want to rent out this flat, as per the above HMO is not required?

Two people is never an HMO.
Being unaware of a third tenant doesn’t really help you as both the Council and the Courts would expect you to pick up the problem through inspections. It would also likely invalidate your insurance, mortgage terms and possibly lease terms if that applies, and they won’t care whether you knew or not.
