Break clause and deposit

Hi there, we are 9 months into a 12 month contract and the break clause can be activated after 4 months, which we would need to give 2 months notice if we wanted to leave any sooner. I am just wondering if this would result in us losing the deposit if we leave any sooner than the 12 months? Thanks

No. The deposit is to cover damage, nothing else. You should get it back.

Hi Jessica, Yes as John said, the deposit remains legally your money throughout the time it is held. If the landlord wishes to take any of it, then they must be able to prove that you have damaged the property and/or its furnishings, or be in rent arrears. Activating the break clause is none of these things, therefore deposit money cannot be deducted for it.
