I’ve just moved in to a flat with 2 other people.
Can we all set up our own standing orders to OpenRent for our individual room rents before the payment date, then OpenRent will send the full amount to the landlord?
Or does it just have to be 1 standing order to openrent?
If your landlord has used OpenRent’s standard lease agreement, each of you is jointly and severally liable, as are your guarantors if you have any, for the entire rent, not just each tenant’s individual share. I doubt whether OpenRent would accept three standing orders but that’s up to them.
I own a flat that’s tenanted by three unrelated flatsharers. Additional HMO licence is in place. I used OpenRent’s Rent Now process and their standard AST lease agreement, with rent payable after the first month directly to me. I added the following custom clause: “After the payment of the first month’s Rent, in subsequent months Rent must be paid in full in one payment by standing order to the Landlord’s bank account, details of which will be provided in good time after the Assured Shorthold Tenancy Agreement has come into force.”
My reasoning for doing this is to make it clear that three standing order payments each month isn’t acceptable as it could undermine the concept of joint and several liability.
