Hi I set up original agreement with tenant via Openrent in 2017 but have introduced a couple of rent increases to tenant since then directly. I realise now that the info held by Openrent is incorrect and whilst I can amend to show the correct rent it will only show it as being applicable from next month whilst it has actually been relevant for 2 years. Also I realise that the deposit held is more than is now legally allowed. How should I go about resolving this?
If you contact your deposit scheme you will find they have a process for managing that. You have to do it through the scheme so that the new lower deposit is clearly registered. I did this with custodial and they just sent the excess direct to the tenant
There’s no legal obligation to keep Openrent up to date on what rent increase you have agreed with tenants. Doesn’t matter if tenant is paying you direct. Might be relevant to tell the insurance co if you obtained RGI via openrent.
You should tell any guarantor and make sure they are still content to be guarantor for the higher amount.
If you want you can upload copies of the section13 notices or other correspondence agreeing the remt increases in the ‘manage documents’ area for the tenancy so you have it alongside all the other tenancy docs
