Deposit not secured

Hi all, looking for advice please.
Landlord sold house and I’m moving, but I’m worried I won’t get my deposit back as it isn’t secured, I’ve phoned DPS who have no records of my deposit made last year, the agent won’t supply details or evidence and refuses to give me landlords address, so I can’t even claim against them if I don’t know where they live! I’m very tempted to keep last months rent money as it’s the only way I can think of not to lose my deposit money, any other avenue out there?

Have you checked the other two deposit schemes? TDS and Mydeposits?

In writing, politely but firmly ask the agent to choose between giving you either the deposit certificate, the LL’s contact details which are your right to have by law or the address of their redress scheme so that you can raise an official complaint against them. That should get the ball rolling.

Hi, yes i did the online check on all 3 and called them too, none have any record of me!

I keep asking for landlords address but agent is like a politician with his replies and never answers my questions, I’m getting no-where, his company address is a normal residentual house looking at google maps, can’t find anything regarding his company anywhere online or companies house, I’m beginning to suspect the address is not his and I will have no way on serving papers ect onto the agent or the landlord in respect of my deposit, I just don’t know how to proceed.

Go onto the government land registry and find out who owns your property
Then write to that landlord

I wouldn’t recommend you withhold the last months rent as it could cause problems with future renting. You hold all the cards anyway if the landlord has failed to protect your deposit, so I wouldn’t worry about it.

whoever owns the property might not be the LL.

@Steven34 then the agent may not actually be a registered agent and therefore may be letting property illegally. I suggest you pay your last rent, document condition of property in detail with a large range of photos/video, move out and request your deposit back in full. If you don’t get it, contact a no-win-no-fee solicitor (if you want, PM me for details of one who has successfully won a claim I helped a friend make) and they will get you your deposit plus a penalty against them which could be sizeable.

At the same time, you should report the managing agent to the Property Ombudsman and the Property Redress Scheme using all the contact details that you have.

I recommend this procedure not only for your own benefit but for anyone who comes after you and has to deal with this agent/LL.

Thank you for advice, I tried to explain to agent that the deposit should be returned but he said no! I’ve already contacted tenant angels and a solicitor is sending paperwork to agent/LL, hopefully they will settle before court action, but I can gaurentee the agent will wish he’d of returned my deposit when he see’s the claim amount!
