Early termination legal question

In considering early termination of my 12 month contract and agreeing in principle to my continuing to pay rent until a new tenant is found and the marketing fee. Is it lawful for the landlord/agent to re market the property at a higher rent? Surely this could disadvantage me in trying to find a replacement tenant?

You are wanting to leave early Are you not disadvantaging the landlord first?

he has agreed to it. He is not being disadvantaged as I am fulfilling all my financial obligations until a new tenant is found

Has the market rate increased since you started your tenancy? If it has then obviously the landlord will align any new contract for a new tenant with the current market.
Due to government policy many LLs are selling up and leaving the market resulting in rapidly increasing rental rates.

I’m afraid this is something you have to accept. Market rents have increased and costs have increased since you entered into your contract , and no Landlord can afford to relet at the same rates you let at.

Your contract probably says are legally obliged to pay full rent to the end of the 12 months fixed period even if a new tenant is found. But many landlords will reduce this period if they get a new tenant. - if your landlord has agreed to this then this is great for you - but if you dispute the arrangement the default is to return to the contract in which you pay the full 12 months. Be careful !

The landlord cannot get you to pay until the end of term, if they have replaced you as Tenant. They are not allowed to take rent from two people for the same period of time.

The whole context of this discussion is if the tenant is not replaced due to rent increase

I probably should have worded it …’ proposed changes to government policy in the upcoming Renters Rights Bill , which is currently making its way through parliament’.
