You definitely have a way with words, and I agree with you, they will survive, how decent of Keyur to be concerned.
However that is not his problem and he needs to focus on how this can affect him, your advice is spot on and the councils staff are well versed in these matters, these days it’s a common issue and you have to think of yourself first it’s survival.

It just came across that they were taking advantage of someone’s good nature. It is equally wrong whether it’s a rogue landlord or tenant of course.
Don’t know what’s wrong with people these days. I prefer animals too!

My tenants have two months in arrears now and Friday is my last day for insurance claim.
As per Rentguard wording claim must be within 45 days. If I use insurace then they will evict tenant correct? and notice will be 6 months?
Insurance asking me 2 months rent arrears as an excess? Worth to use insurance.
I m in very difficult positionz now
Tenants not helping and not cooperating
Any suggestion??

Very sorry to hear things haven’t improved.

I don’t know anything about Rentguard insurance as never had insurance myself but hopefully someone on here does?

You mentioned the guarantor paid their rent before. Can you ask them again?

Also, maybe keep filling in that form for direct payment from their UC every so often. I know you said UC came back and said they weren’t claiming housing costs but that was then. Things might have changed.

What about issuing them their Eviction Notices? What sort of tenancy are they on?
It’s going to take six months but at least you would have the ball rolling.

Hopefully someone will answer your question about Rent Guard insurance.

I have now Periodic tenancy.
Guarantor used as their one of father and he got redundant so not nicer to ask money from him.

They are getting only UC and they have two kids
Rent guard insurance have two months rent as an excess…
Don’t know what to do.
If I used insurace they will evict them and charged me two months rent and only give next four months rent with six month notice to tenants.

At the moment already have two month rent arrears!!!
Very tight situations due to covid.
Let’s hope this will get clear soon…

I was just re-reading the reasons the UC gave you before.

“We are unable to set up direct rent payments to you.

Direct rent payments could not be set up for one or more of the following reasons:
• your tenants do not get Universal Credit
• your tenants do not claim housing support for the address you supplied
• your tenants must be in at least one month’s worth of arrears, accrued over two or more months
• One of the tier 1 or 2 conditions haven’t been met”

Did you tick the rent arrears box before? It’s worth trying it again as arrears are more now.

It’s very unclear whether they are on UC from the response from UC. Do you think they are still working?

If they have told you they are claiming UC could you ask them why they aren’t claiming the housing costs for their rent?

Has the guarantor provided any proof of their redundancy? Redundancy or not they are still liable.

Of course it’s all possible it’s true but you are allowed to ask for proof.

It appeared, if on UC with two kids, from what I could make out, they would receive around £1100 and they said they received £1400?

I know I could have worked it out incorrectly and maybe they get extra but there’s a discrepancy of £300.

Can you ask to see proof of their income?

If Rent Guard issue Eviction Notices ask them to get one out to them tomorrow.

Thanks for asking. Nothing changed much situations. Still everything unclear.
Sept rent half paid by council DHP payment and they passed to me.
Tenants promised October rent and Sept remaining rent arrears pay by 5th November.
Will see, I can use Rentguard insurance but they will take months rent as an excess and evict tentants.
If I provide notice to them this is currently 6 months…
Not an easy task.

Have to wait till 5th Nov

I suppose that is something but sorry to hear you are still having troubles.
If they are now claiming housing costs you could apply to get it paid direct to you again?
At least whatever the amount is you wouldn’t have to be wondering if they will pass it on or not.

I’m not sure is this thread is still live.
I have just filled out the direct rent payments form online as my tenant is 3 months in arrears and on Universal credit. I expected an immediate confirmation email but didn’t get one. Does anyone know if I should have? Thank you

It usually takes a few days. You should have a response soon. If not, fill it in again or I think there was a phone number to call.
