Ex tenant being chased by lawyers and debt collectors

Hi,

I have an ex tenant who left in 2023, the new tenant has said that they have have debt collectors and lawyers asking for the old tenant. I do not have the old tenants new address, but I do have their guarantors name and address (tenants dad). Should I pass this on to the debt collector or does that contravene gdpr?

What does your contract say ?
Did the guarantor sign a data information notice so that you could share said data ?

Good question, I do not know…it was the standard openrent guarantor contract. I will have a look and see if I can find out.

I have read the guarantors section of the contract and it does not explicitly say I can share their details, so, I guess that means I should not.

Normally it’s a separate entity
It is unwise to sign GDPR terms in the contract as it would expire with the contract
Legal counsel advises to sign a separate data information notice

I wouldn’t get involved. The new tenant or you can tell the chasers that they aren’t there anymore. End of involvement.
