Flat owner no t paying their share of maintenance costs

I live in a Scottish tenement which is not with a property management agency, instead the owner occupiers voluntarily pay monthly into a Close Fund to cover cost of essential maintenance. There is one flat in the building that is managed by a local estate agent and has a tenant, we have no idea who the owner is or how to contact him.

The owner, or the estate agent, do not contribute to the Close Fund, we have been writing to the estate agent giving them copies of receipts for repairs that needed to be carried out, and asking them to pay their share but they ignore all letters. If we phone them they just say they know nothing about it.

They owe several hundred pounds to the Close Fund, all we ask is that they pay their fair share of essential maintenance, many small repairs and improvements to the building are carried out by those owner occupiers who are willing to donate their time.

I would appreciate any advice on how we can persuade them to pay into the Close Fund what they owe and and then start making a monthly contribution to the Fund like we all do.

in England a small fee to Land registry will reveal the owner . Do not know if same in scotland

I suggest contacting Under One Roof for advice. There is a ‘missing shares’ scheme, which means you can apply to the council to pay the share, and the council gets the money back from future sale of the property. Under One Roof
