We just got out rental property back from difficult tenants (took almost 2 years to carry out first inspection, always cancelling tradesmen appointments last minute etc). There are some substantial repairs, including bad mould & damp damage to bathroom wall, skirting and doorframe, as well as the bath (it sank and tenant poorly repaired it himself with sticking on beading ober the 3cm gap between the tiles and bath.
My question is, how do I claim against their reposit - I have 23 days left to make a claim. ? Do I get a quote to see how much repairs will cost, or do we need to get the work carried out first?

Have the Ts agreed to you making a deduction?
They will not agree to anything. After 4 lovely sets of tenants, these have been difficult. The guy made up reasons for me to pay him for repairs on account of being an handyman, a year later jobs still weren’t done. He has 6 CCJs against him but his wife passed the referencing, and I felt sorry for them as they had 2 small kids so against my better judgment took them on. Ended up evicting 3.5 years later after every single tradesman reported that the property wasn’t being looked after. As I said, even accessing the property had been very difficult.. I ended up having to repair and repaint all the walls, there were wax stains, all sorts.. sorry to rant, better than crying

Youll need actual evidence the damage happened during the tenancy.

date stamped photos from inventory at move in signed by tenant and check out report/photos on move out date or soon after.

emails or whatsapp or correspondence acknowledging damage caused during tenancy

Get quotes for repairs.

Get the trades who visited to provide written statements about.the lack of maintenance and get all the messages you have from them. And records of the lack of maintenance from the inspection you did

Doubt youll get anything for repainting or anything that will be deemed wear n tear

I have plenty of photos and correspondence. I wasn’t sure of the process as never had to deduct anything from the deposit before..

Then you need to make sure that your proof is watertight (before/after inventory with photos) and that you only claim a reasonable amount. They are likely to challenge your claim and then Reposit will make a decision which, to be honest, is more likely to side with them than you.
After 3.5 years with two kids, you’ll need to allow for a reasonable amount of wear and tear.
