Incorrect N119/N5

Hello,

I filed a section 8 claim online for possession for unpaid rent. The rent is due on the 25th of each month.

Unfortunately, as I’ve completed the forms today (24th), I have included the rent that’s going to be owed tomorrow in the statement, the n5 and the n119.

Is there any way to recover this?

As long as its at least 2 months arrears its ok. It will be several months until you get a court hearing, so arrears may increase further yet. If your claim is successful, you will be awarded all the rent owed at that point. However, getting ghe tenant to pay it is another matter.

She hasn’t paid the rent today so the amount is now technically correct. I’m just concerned that when I filed it yesterday, I included today’s rent so yesterday’s form would be inaccurate.

I am concerned that she may use that as a get out by stating that the formers were inaccurate even though she owed me four months of rent

er… today hasn’t finished yet, and it’s a Bank Holiday so technically, you need to give it until COB tomorrow.

well that may be… but my point was that while you originally thought you’d a be a day out, in this case you’re actually 2 days out. I sincerely hope that doesn’t cause problems.

As I said, as long as at least 2 months rent was owed owed at the point you served the s8 notice (assuming you used ground 8) and the same applies at the time of the court hearing, youre fine.
