I ask because a prospective tenant wants to move in with husband and brother-in-law. That will make them three adults. If not a family member, i wondered whether this would have a HMO implications. Thanks.

Is it the husbands brother?
David 122, yes this is the husband’s brother.
Ann.
Then it wont create an HMO as there is a chain of family connection.
Alright. Thanks David 122, appreciate your responce.
Ann.
Have you seen ID or something to corroborate that claim
Relationship through marriage don’t create HmO’s
I think i understand what you mean Gary. But what sort of proof would the LL be asking for? If the ‘so-called’ brother-in-law is a false claim, how can that implicate the LL. Do I, the LL have the right to ask for evidence of relationships. I mean, how far can one go with these things.
Ann.
Well 1stly if he us staying in your house you ha e every right to ask who he is
2ndly surely he must have a passport or driving licence or some for m of ID that has the same surname as his brother
Personally it seems a bit starnge to me a brother in law moving in with a couple
Put yourself in that position (obv i dont know your circumstances) would you be happy with your brother in law moving into a property with you and your husband? Not staying with you but LIVING with you? This just screams dodgy to me is there some reason that they NEED the b-i-l there (to pass credit checks etc) what if they have a fall out as a family what happens to they tennancy then
I (and let me say at this point have never been a ll just lile to think i have a modicum of common sense) would be extreemly cautious dont get me wrong some of the ll on here may say it seems fine they obv have exp i dont just my opinion
Thank you Gary. What you just said crossed my mind. Mmmm, caution is the word. This family are due to view the property tomorrow.
Ann.
A signed letter from all the occupants confirming their relationship to each other would be sufficient.
Great. Thanks David122. I think that will cover me as part of contract declaration.
