Is there a way to create AST contract without provision for monthly rolling contract after the initial period.
The tenancy contract created by OpenRent has this line by default
“And then continuing as a monthly contractual periodic tenancy until terminated in accordance
with this agreement”
I was looking for AST contract to expires at the end of the term, and probably give provision to extend only after mutual agreement.
It is possible to create a fixed term tenancy that ends on expiry of the term, but it won’t help you. s5(2) of the Housing Act 1988 causes a statutory periodic tenancy on largely the same terms to arise in its place at that moment. So in practice you choose between an SPT and a CPT.
If you are letting property detail is important as a mistake can be very costly. Can I suggest some training to help avoid this.
ASTs will automatically become periodical even if the contract doesn’t mention it. But you can just give notice to prevent that. If you really want to, I guess you can serve notice on the first day of the tenancy so that it will end after the fixed term. I don’t think it’s good practice and I wouldn’t do it, but legally I think you can.
You cant serve a valid s21 notice in the first 4 months of a tenancy and they only have a shelf life of 6 months, so timing would be critical. If the tenant ignores the notice then the periodic tenancy arises anyway.
