Hi, can anyone shed light on this? My tenant’s fixed term had come to an end in July. I stipulated in the contract it would come up for review/renewal every month of July where either party can give notice to vacate. If no notice is given the contract will automatically resume and renew until the next month of July.
Is this now considered a fixed contract (although not signed again for) or periodic or simply invalid?
I think you may have created a mess. It looks to me like a periodic tenancy with a 12 month period, but potentially with assymetric rights as the contractual restriction of tenants notice is probably unenforceable, whilst you may be bound by it.
I think youd better speak to a housing lawyer to sort it out and stop drafting amateur clauses.
