Hi members! Need some guidance please. My current tenancy agreement has a maximum occupancy permitted of 2. The couple (my tenants) have their mother in law coming from India on a tourist visa. The visa will be valid for 6 months. She will probably stay for around 4-6 months. The tenant has asked if the permitted occupancy can be permitted to 3 people for the purposes of their mothers visa application. My question is what do i need to do in this situation if anything at all? Thanks in advance!
Assuming that the property would not be over-crowded, I would ask them to send you a signed note stating that they wish their Mother in Law to stay with them as their guest for a period of up to 6 months; that she will not be living there permanently and has a permanent home elsewhere and that she is visiting on a 6 month tourist visa. I would then respond with written permission for the MiL to stay as their guest and for a period not exceeding the duration of her visa or 6 months, whichever is shorter. You then need to check after this period that she is not still there, otherwise you would need to take further action. You should not amend the tenancy agreement and I believe that this course of action will not require you to do a right to rent check on the MiL. You should check this with the Home Office.
