Tenant moved in with her partner and 2 daughter. After a month she brought her mother living with her. Now she wants to bring her partner son on Ukraine visa.
It’s a 4 bedroom house. I said it will be crowded..
In regards to: “What are your rights to refuse”, the below are points to be considered:
Council Licence
If your BTL requires a licence, the licence would normally state the maximum number of occupants allowed.
For a 3 bedroom house I have only 5 are permitted (inc. children).
BTL Mortgage
If the house has a mortgage, there may be terms with regards to “additional occupants” i.e. they may require notification of additional occupants, and/or their consent may be required.
…as it can affect the mortgage company’s ability to repossess the house, if ever their is a default.
Insurance
The Insurance company, may need to be informed as you are increasing the risk factor. If accidental / malicious damages occur as a result of a person living with you, but not on the lease, the insurance cover could be disputed.
Wear and Tear
A certain degree of wear and tear is expected when letting out a place, generally the wear and tear expected from the tenant’s family at the time the lease was signed, would be significantly different to that expected from what is now being proposed.
You have the right to protect your investment and say No!.
It wouldn’t be statutorily overcrowded if there is a bedroom big enough for the daughters to share. If they’re otherwise good tenants and looking after the place, I wouldn’t refuse, although I would look at a rent increase after the first 12 months.
