My Landlord has faked my Deposit Certificate

Hi All,

My Landlord sent me a DPS certificate and he had deleted the date the deposit was protected. This has been confirmed by the DPS that the certificate he sent me was fake.

Over the course of 9 years, I have never received a certificate until last month and have never received the prescribed information. My landlord also only did the first Gas Certificate at the property recently and that was only done because he was trying to serve a section 21, so he could sell the property.

My questions are:

  1. Does the statue of limitations still apply for claims relating to failure to protect deposits, if the landlord has mis-lead me by creating fake certificates? Or if I never received any information regarding the deposit.

  2. The deposit my landlord sent the fake certificate for was from 2017. But we signed a new contract in 2020. Does this mean he gets away with all the contracts he didn’t protect before July 24th 2018?

Yes, if the deposit was paid 9 years ago and the tenancy has not been “renewed” within the last 6 years, your out of time for a penalty claim.

If no gas cert was in place before the tenancy began he will never be able to serve you a valid s21 notice.
