Need more time to find house

Hi, my fixed term contract expires end of july. Landlord gave 2 months notice end of may that wont be renewing contract. Problem is there is no properties available to move to at min. And have been in and out of hospital with my daughter who is 8 for last 13 weeks. Plus my wife is not keeping great. Will be going for surgery in few months for gall bladder. This is putting lots of stress on us. Should we explain to landlord and hope they give us more time? What if they say no? We have nowhere to go, whats our options? Can we refuse to move until find somewhere? Our rent is up to date, always paid on time. Havnt caused any anti social behaviour. Landlord knows would still get rent until we move.

Hi. Yes, best to have a discussion with landlord. You say he gave notice he ŵasnt going to renew, did he give you a section 21 notice as there is no need to renew a fixed term tenancy, it automatically converts to a rolling periodic tenancy. If he hasnt given you a s21 notice he hasn’t given you notice to leave.

You can refuse to leave at end of s21 notice, in which case landlord would need to go through courts which would give you more time but not a good option as you could be responsible for legal costs and find it harder to rent in future so i wouldn’t recommend unless you genuinely have no other option.

Landlord gave us a letter at end of may saying the tenancy ends 31st july and wont be renewing it. Says we have to be out by then.not sure if thats a section 21.

It doesn’t sound like a section 21 notice. If it is it will say its a section 21 notice. If it is not, it is not a valid way to end a tenancy, in which case at the end of your fixed term, the contract will automatically become a periodic tenancy.

Your rental agreement I am sure will explain this. Have you had a read?

The letter states -notification of termination of tenancy agreement as of the 31st july. No mention of a section 21

Its not a formal notice and youre not legally obliged to heed it.

Can landlord not give a section 21 until tenancy ends on 31st july?

Landlord can issue a section 21 2-months before the end of the fixed term.

Lots of LLs are selling up due to Labour and Conservative proposal to abolish section 21 (no faults eviction) if they win the election. S21 is a safety net for LLs and life without it can be difficult. They say they’re on the tenants side, errrr! As more tenants vacate over time - more LLs will sell up!

I second the suggestions to explain your situation to the landlord, don’t mention section 21 at this point (I can’t say whether or not that is needed, having never had need for one myself)

Landlord refused us more time. Said have somebody ready to move in when we go.

I think you have established above that the Landlord has not given you a formal Section 21 notice. So any notice she has given to you is worthless.

On 31st July your tenancy will roll into a periodic tenancy. The Landlord needs to give you a valid notice & re-start the 2 months notice, which buys you more time.

If you are certain, its not a section 21 provided, then I would hold fire, and not highlight this to the Landlord yet. Even after 31st July, I wouldn’t highlight this. Wait until they try to evict you & finds out their notice is invalid. This buys you lots of time to find a new property…

In the meantime, if you have any doubts about it being a valid section 21 notice, speak to Shelter or citizens advice.

I would also ask the Landlord now for a written reference to help you find a new property.

Am in northern ireland, phoned housing rights who said landlord sending me the letter end of may giving two months notice would be valid and they dont need to send an s21 notice at end of term.
