New contract or deed of assignment

Hi all, we have joint tenants in our property with three people named on the lease (husband, wife, sister).

We are just about go into a rolling contract which is our preferred option rather than renewal. The tenants were happy with that but now they’ve called to say the sister wants to be removed from the contract.

Can we just add an addendum stating that she has been removed as of x date? Or do we require a deed of assignment? Or a brand new contract altogether?

I dont believe that an addendum would be sufficient. The sister moving out is a significant change. I would probably re-run affordability checks on the other two first. If all is ok, I would end the current tenancy with a deed of surrender and start a new one as its much cleaner. Dont forget to do a checkout inspection and deal with the deposit.

Thank you David, this is very helpful. We hadn’t thought about the inspection etc. completely understand now why it’s cleaner to create a fresh contract.
