If I give notice to my tenants and the end date of that notice period falls past the last day of April this year will the new rules that come into force on 1st of May apply?
You have until 30 April 2026 to serve a valid section 21 notice. If the notice is deemed not to be valid due to a technicality (which many are) you would then need to serve a section 8 eviction notice under the new rules from the 1st May.
Thankyou Christopher, that is different to some info I found after posting this question.
Also in terms of technicalities im not surprised many notices are deemed invalid as Im finding it hard to clarify even whether I can use the form 6a or not. Some sources say as long as there is minimum 2 months notice is doesnât matter what date the tenants are asked to move out, other sources say the date must be the last day of a rental period ? Itâs all very confusing
See âGuide to the Rentersâ Rights Act
Published 6 November 2025â
Ie
âThe Act makes specific provision to ensure a smooth transition and avoid unnecessary âcliff edgesâ, for example maintaining the validity of rent increases and notices served prior to implementation.â
so if you serve a valid s21 before 1 may it is still valid from 1 may onwards
See also âRentersâ Rights Act: Transition rules for existing tenancies in 2026â on the independent landlord blog
Good luck
The s21 notice no longer has to expire at the end of a rental period. Google ânearly legal s21 flowchartâ for further help.
Yes you can serve 21 up to april but maybe dont leave it so long. There may be a lot of section 21 s issued in april and the courts may overloaded in october when going to next stage
