fixed term ends in 2 months, tenant emailed me back that he is not going to stay after it ends. I don’t then serve sec21 in such cases. so in this case I didn’t, Now tenant threatening that I did not give sec 21 notice and will report to council. but I know they will leave, just waiting. fixed term ends in 1.5 months. 2 months ago tenant confirmed in writing of leaving. advice pl
The tenant is unable to serve a valid notice during the fixed term, so his email is just an informal notification of his plan to leave, which you cant hold him to and he may change his mind.
I dont understand the bit about why he wants a s21 notice, but unless you want him to leave, you have no obligation to serve one and can just wait and see.
