Hello all, my current tenants are foreign nationals and have a “right to rent up” until August next year. If they do not get this extended, how does it work with notice period’s after the renters reform going through?
Do I provide a 4 month notice period, or do they provide the 2 month notice period? My initial thoughts are for me to provide the 4 month’s notice period, is that correct?

I believe it’ll be Ground 7b under a Section 8 eviction, and will require two weeks notice before starting eviction proceedings, but do some research & check the grounds to be sure.
You can currently give them up to a 12 month tenancy even if they have only 1 day remaining of their right to rent. You would check again near the time the term expires and as Karl says, there is an eviction ground for someone with no right to rent.
Once the RRA commences, this will need to be different.
Be aware that if they are your tenants and their right to rent actually expires, you have to report this to the home office and do not have to go through normal eviction routes to remove them from your property.
Call the Right to Rent Landlord’s helpline for more details on how this would work. It’s a lot simpler to remove them than to remove tenants who do have right to rent.
Be aware if their Right to rent expires and you dont not inform the home office within their time frame you can face a £10,000 fine and upto 5 years in Jail. !!!

all tenants will be required to give 2 months’ notice unless you agree a shorter period with them. For those who have a limited right to rent, you should be checking this and talking to them well before their deadline. If there’s a risk that they might be there without a right to rent, call the number I mentioned above. They’re very helpful.
