Sale of property - local authority

Sold my property (No completion yet) but the local authority have been appalling in helping my tenant. She’s vulnerable along with her 23 year old son who’s also very vulnerable.

They’ve told her - don’t worry he’ll have to go to court to get you out. She’s now into the 5th month of the eviction notice and the local authority (Wales) have been appalling in helping her (or not more accurately).

Is this legal? Can I do anything about this?

welcome to the lying word of the local authority . You will never get them to help until bailiffs arrive

I’m appalled at their actions but is there a way to challenge it? Is it not a case for the Ombudsman? What is the legal position?

carry on up to the bailiffs it is the only way . Central goverment tell them not to do this , but local authorities take no notice., as they have no places You are on your own

Im amazed youve got a buyer that was willing to exchange contracts with a tenant still in there. It could take you a long time yet to get them out.

Not exchanged yet so I’m in a very difficult position. I am making a corporate complaint about this action by RCT Council and will also take it to the Ombudsman. I think it is grotesque that a local authority feels it can behave towards well meaning landlords in this way. They’re effectively trying to prevent a private citizen from exercising a right to legitimately and legally sell my property. I’m not going to tolerate it

So you havent sold then. Youve just had an offer. Advertising a property for sale when theres a tenant in place is a bad idea for this very reason. This is what all local authorities do.

Good luck with your complaint, but I wouldnt hold your breath.

Today I’ve written to the CEO of the local authority and the Welsh Housing Minister about this practice of advising tenants to let landlords go to court and strongly protesting its immorality. If the replies are unsatisfactory then I’ll be speaking to the press.
