Section 8 Ground 12 Speed

Hi could I ask if any one served section 8 ground 12 for tenancy breach and have a timeline to share? It is just to understand a rough guide on granting a possession.

Ground 12 is discretionary and unlikely to result in a grant of possession except in an extreme case.

I do understand that but I just need to understand the speed of processing from anyone experienced this. People can refer information from elsewhere but it would be best to have someone who actually did it.

Well to give you an idea, I’ve started court proceedings for section 8 grounds 10 which is mandatory ground and 7 months in and few hearings still haven’t got my possession. Final hearing in August/sept.
to reiterate that’s a mandatory ground too so for discretionary ground well……

Ground 10 is not mandatory, but the court case takes the same amount of time whether the grounds are mandatory or not.

why does it need few hearings? shouldn’t it just be one give all evidence then done and dusted?

You get 15 mins slot at the first hearing, if the tenant doesn’t turn up then you’re laughing and should get your possession order as long as they haven’t filed a defence.
If they turn up and say they want to file a defence then another hearing is required and maybe a another until the final one. Long long process, i’m still in one and it’s been 8 months so far, final hearing in a few months. From what i have read, courts everywhere have a long leadtime.

so how long was the first hearing? and what was your issue for the eviction?
