New landlord here, my first ever and decent tenants want to leave. An AST is in place: ‘Fixed term of 12 months until 22nd June 24’ The initial term. Tenancy also states that the ‘Break clause can be activated after 4 months’. My tenants want to move out on 1st June. Can I ask them for rent up until 22nd June or not? Thanks, Sue
I believe it would depend on the wording in the tenancy agreement in relation to notice periods. Some specify that the notice period should be served so it ends on the last day of a rental period. I am relatively new also so please get an opinion from an experienced landlord.
Unless your tenancy agreement says otherwise, a tenants notice to quit must expire at the end of a tenancy period, so ifthats 22nd of each month, a notice given now must expire 22 June. You can choose to let them goearlier and waive the payment, but you are entitled to rent until 22 June.
I would let them go as it’s only a few weeks and a unhappy tenant can cause a lot of damage in a week
