Hi. So I have agreed a new AST, contracts all signed however they still haven’t paid the deposit or month 1 rent.
I feel this is a bad start and want to back out. I feel technically they are in breach of contract not paying the deposit immediately or even by the agreed date after I chased it.
Do I need to agree a surrender with them or can I just back out?
Move in date is in 4 days.
If they haven’t paid the deposit they don’t move in. If you are using an OpenRent agreement message them to fact find. Deposits are paid prior to move in so act quickly.
They don’t yet have a tenancy, so you don’t need a surrender. Unless the tenancy agreement is signed as a deed, (which would be very unusual), they also don’t have a contract until they’ve paid.
I understand you getting the jitters over this, but are you being too hasty? There may be a perfectly valid reason for this.
