Statutory declaration - tenant using former tenancy address

In terms of the deposit, tenant is using the former tenancy address in the declaration

“I (name) of (former tenancy address here), do solemnly and sincerely swear that…..”

[I was the tenant at all the tenancy details and address given here and amount, then in the landlord and letting agency section they have added their own name/phone number]

I have queried this and keep being told its valid, as a change of address doesn’t change the tenancy details. But that’s not what I asked, its the initial declaration.

Royal Mail redirect is active, so here I have tenants stat dec, with the above as they have redirected it to their actual new address. It seems tenants have a right to redirect mail and be contacted at a last known address, but making a stat dec saying you are ‘of’ for the former address?

this isn’t at all clear.

why is a stat dec needed for a deposit?

suggest you rewrite this so we can actually understand what you’re asking

tenant completed a stat dec stating they had had tried to contact agency/landlord but did not get a response,

Perhaps the agency failed to do something which has caused this process, or didn’t claim the deposit?

Costly damages were left at the property, no cleaning was done

Still have no idea what the situation is. Could you spell it out for those of us who aren’t you?

What process?

whose property?

what have you asked?

initial declaration of what?

Sincerely hoping to understand your situation here, but failing. Anyone else got a clue?

Are you sure the real fault is not with the agency? Did they ignore contact from the tenant? Did they get a written assessment of the damage costs in a timely manner? Did they attempt to make a claim against the deposit on your behalf or pass the details to you to make a claim?

IF one party doesn’t respond on the custodial scheme in order to release a deposit the other party will require statutory declaration to get the process going

If we are at a loss…I’m not surprised the tenant is too!
