Surrendering a tenancy and creating a new one

My tenants are surrendering their tenancy and a new tenancy is being created so that one of them can remain. When do they sign the new tenancy?

If the new tenancy is signed after the Deed of Surrender ends the original one, then there will be a period where no tenancy exists, but the property is occupied. This could be only a few minutes, but if the tenant refuses to sign then they will effectively be squatters. If the new tenancy is signed before the Deed, there will be two tenancies in force which is not possible. Help!

At the same time. And the Deed is signed as the other one walks out the door.
