hello everyone. I’d appreciate some advice.
I have a 2 bed flat that I rent and the tenants have been there for a year. the tenancy agreement were on the assumption of 2 adults and 2 children. After a property inspection, I’ve noticed there are considerably more beds then needed. x3 singles in one room and a double and a single in another.
Is there anything I’m liable for and is this something I need to be concerned about?
The property is otherwise clean and tidy but does have more wear/tear than I was expecting for a year.

Well for starters they have lied to you so thats concerning if they have lied about something like this what else have they lied about?
Are they all related or are they sub letting
And (I know this may seem a novel idea) have you spoken to them and asked them why and what was agreed
Have you explained they may be in breech of the TA
Plus (and i dont know the exact numbers am sure someone experienced will) children of certain ages shouldnt be sharing with children of opposite gender
It MAY be that at that time they had some family visiting and had accomodated them (highly unlikely but ya wont know unless you do another inspection or speak to them)
Just send them an e mail or whatever means you use to communicate with them (im guessing you do) saying along the lines of (and again im not experienced or a ll)
“I noticed on the last inspection facilities for more than the permitted number of occupants as per TA please could you confim who these other people are and that they are no longer residing there failure to confirm this will be treated as breech of TA and the appropriate action can be taken” see what reply you get and take it from there I would SERIOUSLY consider starting eviction though as the trust element has completely gone

I asked and she said something vague about a child sometimes staying with her but also staying with another family member. It didn’t account for the amount of beds at all.
I don’t know if it’s extra family or subletting
I assume extra family…there is only 1 bathroom so this would be way too much!
I’ve been advised to serve a section 21 but I’m going to ask over text for an updated list of who is there and ages…see what comes from it. All other communication has been fine with her and she’s very respectful so its been a shock.
The house may be statutorily overcrowded and they may have turned ut into an HMO. You need to ask them formally to put in writing to you who is living there to cover yourself in case of Council prosecution. I would suggest doibg this before commencing any eviction proceedings.
I hope that you continue to be covered for insurance. I have to declare my tenants to a freeholder, so would look very seriously on this.
I would deal with it sooner than later if you message and ask for a list of who is living there it may take them a while to respond either physically speak to them or give them a deadline
Please respond by otherwise eviction procedings will commence and if necessary go through with the threat
