Hi - I have a registered HMO with 5 tenants. I’ve been able to swap out tenants mid term by having the old AST re signed by the whole group with the new tenant added and old one dropped. Is this possible under the new tenant rules post May?
The process is a little more involved than you suggest. if you want to assign the tenancy you need a deed of assignment signed by all the old group and all the new group. If you want a new tenancy, you have to end the old one first before the new one can take effect.
As far as I’m aware the above isn’t changed by the RRA, although there was a tantalising sentence somewhere in an early draft or guidance document, (I don’t remember which) about the RRA making it easy to add tenants to tenancy agreements. I’ve seen nothing further on what was intended here.

Openrent ‘rent now’ allows this. Steps as follows
Manage tenancy
…Renew or amend tenancy
…Renew the tenancy, or add or remove tenants
(Or similar to end old tenancy and start new one but that might mean return deposit get new deposit, re serving the gas safety record, how to rent etc. I’m sure OR support can give you the options. Another would be to have individual asts with each tenant in future)
