Tenancy Agreement- Joint Tenancy

Hi!

I am looking to leave my flat at the end of the Assured Shorthold Tenancy Agreement that I jointly signed with my flatmates.

In the contract it states ‘The Tenancy shall be from and including the 15’ June 2024 (‘the Commencement Date’) to and including the
14h May 2025 and thereafter from month-to-month and until terminated by either party serving a notice on the other in accordance with this Agreement.

I am trying to find a replacement tenant before the end of the contract but wanted to confirm that if I gave notice of my intention to leave and left at the end of the tenancy agreement, I would not still be liable for the rent if the other tenants intended to stay?

If it’s one tenancy agreement, that you all signed jointly, when you give notice to terminate the tenancy, it ends for all.

It’ll then be up to the LL & remaining tenants to agree a new tenancy agreement between them if they wish.

Is there any term of the agreement requiring you find a new tenant?

When the departing tenant wishes to leave before the end of the fixed term the departing tenant remains jointly liable. A LL may insist that a replacement is found before releasing the departing tenant of their obligations. As you have served notice to leave at the end of the fixed term your liability ends. The LL and the remaining tenants will have to create a new tenancy and it will be for them to find a new tenant if they wish to do so.

It sounds as though you have a contractual periodic tenancy. The agreement should state when and how you give notice and you must follow it to the letter. The rules for fixed term tenancies and statutory periodic tenancies dont apply.

Unless the contract indicates otherwise, you can unilaterally serve notice, which if valid will end the tenancy for everyone as Karl says.
