Tenant Eviction

Hello All, I have issued Section 21 notice with end date as 28/June. Deposit has to be claimed within the 10 days after the end date but only after the tenant vacates the property. I have a claim to make. If the tenancy doesn’t move out after the end date, then I cannot claim the deposit and also have to cancel the End of Tenancy in OpenRent to hold/secure the deposit. By cancelling the end of tenancy, the open rent portal will resume all activities like it would normally do for an active tenancy. Now, I’m stressed that if the tenant doesn’t move out in my case (no indication to vacate) what happens to the following…

  1. Deposit - I think there is no other option other than cancelling the end of tenancy to secure the deposit. But writing to the tenant to confirm that there is no change to the Section 21 notice and I expect them to move out. OpenRent end of tenancy is only to make the Deposit secure until they leave the property. Is this approach good?
  2. Rent - whether I should cancel the rent collection or not after the tenancy end date? What are the pros and cons of both (i.e. continue to get rent but working on eviction process or don’t get rent but work work on the eviction process).
  3. Section 21 - I think this would be still valid irrespective of what tenancy status is there on OpenRent, isn’t it? And I can make use of it and proceed with the next steps for eviction process?

Please advise with your expertise. I’m new to these problems and seeking help. Time is short and I’m stressed.

Why have you opted to end the tenancy on Openrent? Surely you dont do this until the tenancy actually ends. S21 doesnt end the tenancy unless the tenant actually leaves and you wont know this until the notice expires.
