Tenant hoarding

Hi,

I have a tenant who insits on storing his personal items in communal areas - is there anything I can do to prevent this?

Have you asked them to remove their belongings?

What does the AST say about keeping communal areas clear?

Is this a fire hazard? What does your Fire Ridk Assessment say? Has tenant been provided with a copy of fire risk assessment?

I’d discuss with tenant if any alternatives (i can understand why some tenants wish to leave a bike in a hallway not sure about anything else - can something to chain a bike to be put outside ..etc) look at whether blocking escape routes for a fire and ask neighbours in house/block too. Presumably you want to keep tenant so see if there’s a solution.

The standard OR AST has this clause for tenant responsibilities- if need be tell them they are in breach and due to obligations for fire safety, you will have no choice but to have anything left in common areas disposed of if it continues. Give a deadline to clear and monitor. Confirm in writing.

“9.17. If there are common parts to the building, not to obstruct, keep or leave anything in them.”
