Tenant in prison

Hi just found out that my tenant is in prison awaiting trial.
Whilst he was living at our property he had a strong of girlfriends come and go, however his latest girlfriend has been living at the property for the last 2 years.
We know her first name that all, she has no tenancy contract with us, and we have just discovered that she was involved with the crime and been bailed to that property.
What can I legally do to recover the property from them.
From what I have heard from neighbours she is not a very nice person to deal with,

I would advise you seek legal advice
Just because the tenant is in prison does not mean the tenancy ended.
She may be a sublet / trespasser.
This is a complicated legal issue and I would advise you to get professional advice.

If you want her out you could pay her to leave but I would instruct you do those kind of matters through a solicitor with that person

The tenancy hasnt ended and wont end automatically even if he las a long prison sentence. You need to take steps to end it. You could try to get him to surrender it, but I doubt he will. His girlfriend has a right to be there as his guest as long as he wishes. You might be able to get rent paid through benefits in the meantime.

She won’t be able to stay as a guest indefinitely. She would be breaching the guest clause if there is one

A guest clause in a tenancy agreement is not something a landlord could use to remove the guest, only to sue the tenant for breach of contract, which would likely only be a paper win.
