My tenants gave two months’ notice on an AST which would take them up to 2 Dec but
they are actually moving out on the 7th Nov.
I’ve now had an enquiry from someone who wants to move in on the 9th Nov. If they take the property am I obliged to refund the original tenants from 9th Nov ie am I allowed to take two lots of rent for that period as contractually the original tenants had to give two months’ notice ?

Does it make any difference that this second booking would be coming via Airbnb and only for two months max? I wouldn’t know exactly what I’d be making until all the Airbnb fees etc have been taken
No it doesnt make any difference. The tenant has exclusive possession until 2 Dec. You have to get their permission to take back possession before then and would then owe them a rent refund.
As this means that you actually had to have advertised the property as available from the 9th of November, I’d be making sure my current Ts and anyone you’ve got lined up are aware of that. If for some reason they cannot actually move out according to plan, you’ll be in a bit of a bind if you’ve promised it to someone else who’s expecting to move in. Personally, I don’t line up a move in date until I have the keys back.
