Tenant wants brother to move in who is already guarantor - best to add him to the contract?

Hi folks,

My (single) tenant has requested her brother move in with her. I’m fine with this as was open to couples and there is space in the property. He is also one of her guarantors.

  • Does the guarantorship complicate things?
  • Should I add the brother to the contract as a tenant, or would adding him as a permitted occupier suffice?

As long as you don’t take any rent from him, you can add him as a permitted occupier. The fact that he’s guarantor AND living there only increases the likelihood that the rent will be paid. (It does beg the question why he’s a guarantor if he doesn’t own his own property though… but that’s water under the bridge now).

If you added him as tenant, you’d have to end the first tenancy, return deposit and issue a new tenancy in joint names with a new deposit etc. He couldn’t then be her guarantor but he’d be responsible for the place under joint and several liability, but that’s a lot of hassle for effectively the same situation you currently have.

If you add him as a PO, inform your insurance co and (if you have one) your mortgage lender of change of circumstances.

You could increase the rent (if your contract and the market allow it) to cover increased wear and tear but whatever you do, don’t take any money from him under your current agreement.

I have never agreed this and as far as i am concerned (as the only guarantee) on this property never give concent when Molly Cranmer moved out for anyone else to move in Molly Cranmer moved to a new property, give proper notice to the landlord. told universal credit and council tax of new property so there is a correct paper trail. The reason she moved out of Albion Hill was because the property was unsafe and as of today is still unsafe. Please remove all of my details for this property as i am not liable. I am now taking legal advise to sue the landlord. Regards Lorraine Garrod
