Tenant wants to change rent payment day. Will it renew the contract for another 6 months?

Hi all,

I have this tenant that keeps putting her stuff everywhere obstructing the common areas and all the other tenants have also reported to me the same thing. A few weeks ago, she brought large bags and boxes of clothes into the living room and had a strong smell of mold.
Since then, I’ve written to all, to keep their belongings in their cupboards or in their rooms. This same tenant has started to report on the other tenants to the Police and Open Rent about others moving her stuff, touching it or even occupying her space.
She basically moved in last, but that’s just my point of view.
When things started to escalate even more (two/three weeks ago), she asked me to change her rent day payment from the 15th of each month to the 1st of each month. I didn’t change it (please correct me if I’m wrong) because it was going to renew her contract for another six months and take longer for me to remove her from my property.

So yesterday, it was her final two months of contract and I served her a section21 notice on open rent and personally printed it out and placed it in an envelope under her door (I video recorded everything with my Go-pro on my head and phone at the same time). On that same day, she emailed me with a photo of the letter by her wardrobe and wrote that someone entered her room without her permission and that she has now reported everything to open rent and to the police.

I think she’s trying to be clever and doing it on purpose probably trying to get the others to move out just to bring over her lousy friends over. She did ask me once if any of them was going to move out because she had some friends that would rent a room…
By the way, my son also lives in the same property and has reported the same nuisance with her, but has his own space in the loft.
Any suggestions, advice on what should I do from now on?

You don’t need a new contract to change the rent payment date, but you don’t have to do it if you don’t want to and in these circumstances I would probably also refuse.

Just make sure your s21 is valid by checking the Nearly Legal s21 flowchart. It may take a few months to remove her if she resists, but you should get possession if all is well with the notice.

Thanks.
I do have a HMO licence.
Do you know if I’m obliged to upload it on her tenancy documents?

I dont know the Openrent protocol on this as I dont use Rentnow, but if you havent, it shouldnt affect your possession claim.
