Too long notice for s.21?

I served a s.21 via Open Rent in July 2024 giving until 1.8.25 to vacate. Tenants have failed to move saying they can’t find anything suitable. On contacting Landlord Action their solicitor told me my s.21 was invalid as I gave them too long a notice period. Is this right? I tried to be kind to a small family but sounds like I should have given just the minimum 2 months. What are my options now??

You have 6 months to apply to court from the date you serve the s21 so yes it is now invalid. Only option is a new s21 assuming you still want to evict them.

Thanks Richard. I’ll have to do that. My first time having to do it so am now much more aware that trying to be super helpful not necessarily the right route.

Best of luck. If they don’t leave some courts have a backlog of up to 15 months!
