10-month tenancy and Renters’ Rights Act

I have rented out my flat for 10 months a year the past few years and then lived in it for 2 months in the summer myself. I want to do this again after the Renters’ Rights Act comes into effect but it seems that fixed term contracts are no longer possible. What’s the solution here?

In answer to your question, you can’t do this.

I’m in the same situation with my brighton flat, I’ve been using it for the summer and it suited my tenants but now? I will use Airbnb for myself for a month and just rent out the flat and who knows how long they will stay?

@Alice27 rent out permanently use the extra 2 months rent and reduced advertising etc costs of new tenants towards an airbnb

You’ll probably be £ worse off but less stress from new tenants every year

Thanks for your reply. I think I will probably end up doing the same thing as you. Though it is crazy that I will not be able to draw up a 10-month contract with students (who have been delighted to have a contract of that length/timing) even though it works for everyone. And I’d be nervous of just taking someone’s word for it that they’re going to move out when it’s no longer legally enforceable.

Yah, I hear you! But this is my family’s second home and it suits us perfectly… its’s kinda the point of owning it. Maybe managed short term stays is the way to go. Ugh!

@Alice27 even previous to RRA if tenants stayed beyond an agreed length as LL.you still have to apply to court for possession which can take many months. So not as much change as you suggest. Under RRA you can still evict by applying to court (with a reason) tho most of the notice periods are longer.

Main difference is tenants aren’t tied in to eg 12m even if their circumstances change after 1m.

Worth keeping in mind if you go the Airbnb route, some councils are enforcing the 90-day short-term let limit now so it varies quite a bit by area.

I would carry on with the ten month deal you’ve been doing with students previously. Worse case scenario the don’t move out and you have to stay elsewhere as would have happened anyway but the likelyhood is that the ten month tenancy will work for them too and you get your 2 months there as you hope.

Under RRA there’s nothing to stop a LL asking a potential tenant their intended length of stay eg saying

“Legally there is no such thing as fixed term tenancies any more and you can move out with 2months notice (ending the day before rent payment day) at any time. My previous tenants generally stayed around 10 months. It would be helpful to know your intended length of stay although as I’ve said it’s nor any sort of legal contract or binding in any way.”

Maybe it’s better described as an ‘informal understanding’ or ‘opportunity’ rather than a ‘deal’ as it’s not a contract but @Daniel159 's suggestion is a good option for @Alice27 to consider nonetheless
