All names on AST?

a new tenancy to a married couple. The wife and guarantor have passed full referencing, the husband is not working currently and will not be contributing to the rent. The wifes income is enough. Do I put them both on the AST is there any benefit or risk to adding or leaving out the husband? adding him as a permitted occupier? or is it better to have them both feature as signed tenants?

I’d just put the wife’s on and make sure the rent comes from an account only in her name, not a joint one. Deal solely with her in terms of the tenancy.

I’d add him as a permitted occupier in a separate document which both you and her sign and both have copies of. I’d make sure that this doc defines what a permitted occupier is and that he is not your tenant.

The spouse has automatic spousal privilege so permitted occupier status is moot
I have married couples who only have an agreement with one spouse and for some houses both spouses
I decide on each tenancy independently

ah… good to know about spousal privilege making PO status redundant.

I don’t know if your periodic is statutory or contractual
If it’s statutory you may want to put his name in it otherwise if she left he would be subject to statute not contractual obligations

Where I have internationals and a spouse abroad o put the resident spouse only. The reason being they don’t have to pay council tax as students or are not subject to 100% tax. That way the spouse can visit without unnecessary council tax responsibility.

If I have a U.K. couple I tend to put both names down .
I think it may be prudent for you to put both names down so if there is issue he is liable by your contract
