Delay in rent payments

Hi! First time landlord here.

Tenancy is 12 months, they pay rent weekly as they get paid weekly so I agreed (this is in the AST) they asked to pay on a Friday, rent is NEVER in on a Friday, consistently late and so far they actually have missed a whole payment and haven’t paid this weeks just gone! I’ve tried texting, I’ve been nice and polite I’ve sent reminders etc. what can I do to rectify this? What are my rights as landlord?

Never write weekly rent into your contract it’s not in your favour
Always write a contract as monthly

The problem with weekly rent is you have to use a rent book
Did you serve them one ?

If not get on and do it

Section 8 after eight weeks rent is missed
You can’t do an s21 without a rent book until two months before end of AST

Thanks, how do I go about this retrospectively then? Get one and fill it in up until now? I’ve seen online about a section 8 and rental payments being late is one of the reasons to evict?

Go to WHSmiths and buy one
Next Friday go to their house with the book filled up to date and collect rent
You will be able to go to the house weekly to collect rent as the book should be filled in!

Thanks so much - am I allowed to keep the book? Google says the tenant should but can’t seem to find loads of info on it :joy:

I have 3 tenants who pay monthly and they have rent books that they keep. At the same time I enter their payment into my diary. They have never lost their rent book Many years ago when the rent man came around to my mum he filled in the rent book that she had and entered it into his ledger

Hi! It’s paid via bank transfer though so I wouldn’t go to ‘collect’ it every week. Unless I should be going there weekly anyway and then she sends it? I don’t understand why I’d need to write it down if it’s in the tenancy to pay every Friday, and my bank shows it’s not in every Friday … when I search online it doesn’t say much about the rules just says they need one?

Colin is right you go round every week and fill in the book and keep a ledger for your records when you go to court/ DPS for arrears

In law all tenancies have to have a rent book
I can’t remember the nuances of why and how ( it’s been a longtime since I read it )but it’s only absolutely necessary for weekly rent now
You definitely need it for a s21 to be served and you may / will need to demonstrate it was served for a s8

I had a tenant on weekly
I gave him a rent book
It was also included in contract , that along with DPS etc, he was served it .
I scanned it in in the beginning of contract so I had evidence he was given it
I made him sign the clause that he has received it

I kept an electronic record in the form of emails sent to him which included rent paid and missed
I didn’t go round every week
The DPS adjudication required a ledger type document which I prepared for dispute to get rent arrears

Your tenant has not paid rent
If she was on monthly and she did not pay rent and you visited her every Friday it would be classed as harassment but your tenant is on weekly so you can visit them every week to collect rent (:wink:) and fill in their rent book
She will accuse you of harassment but it’s not !!!

Now the problem with weekly is that if she misses eight continuous weeks she can be served a s8
If she pays one week ,eg in week seven ) the clock starts over ( a point you definitely should not mention to her!)
( that is why you write monthly collection in contract even if they pay weekly take the first month and then accept weekly .

A rent book is only a legal requirement for weekly tenancies. The contents are also prescribed and in addition to a record of the rent payments, it must include details of addresses, tenancy Ts & Cs etc.
