I have a situation with my current tenancy where a Section 21 notice has been issued, but the tenant refuses to leave the property.
This is going to court and I need to prove that his deposit was registered within the specified/legislative timeframe.
The deposit certificate that I downloaded does not have that detail. I would need this evidence to proceed to court. How can I get this, please as OR took the initial rent and deposit from the tenant and lodged the deposit on my behalf.
Thanks Christopher … I have logged into ‘mydeposits’ and the prescribed information/certificate is available for download but it isn’t actually dated. Very strange. This is an older deposit so I wonder if something has changed. Frustrating as my solicitor is saying I will need to refund the deposit ahead of going back to court to progress to a possession order. And I know that there is damage to the property, so I will potentially need to go through legal proceedings to claim compensation on the repair costs if there is no deposit anymore. The prescribed information and deposit certificate seem to be one document with mydeposits. I used the ‘Rent Now’ option on Open Rent, so they actually handled the documentation. The prescribed information is also in the signed tenancy agreement. Just frustrating that I seem to have no way of providing evidence that the deposit was lodged in the scheme 2 days after it was received (so well within the 30 day requirement).
