Prescribed information (Tenant Depsit)

I have noticed that my tenant has not signed the bottom of the prescribed information document. I’m at court today as tenant owes 4 months rent. Can OpenRent prove that he recieved this even if he didnt sign it?

I don’t know about OR as I don’t use them for serving paperwork.

All I’d suggest is that in future, you always get Ts to sign and date a document saying what paperwork they have received from you.

openrent serve this by email & send you a copy of that email. That is your proof

Ive asked this before but I cant recall if it was answered. The Housing (Tenancy Deposits) (Prescribed Information) Order 2007 requires the landlord to sign the deposit PI and the tenant to be given the opportunity to sign. Non-compliance would invalidate the document. Are the signatures applied electronically by OR?

We have just included you on an email to your tenants that outlines the prescribed information and provides them with the ‘How To Rent’ guide. Please save this for your records.

Further to this the prescribed information is contained in the tenancy agreement all parties have signed, including details of the deposit amount, where it will be protected and how it will be treated.

Coupled with the email you just received, this goes beyond the minimum legal requirement; note that the law states the information is provided to the relevant parties so printed signed forms are not necessary.

Late back to this discussion sorry, thanks for your Information @Karl11 it does make sense. Another related question; Is the “prescribed information” essentially the deposit certificate or is this something else? my solicitor has the “prescribed information” but was asking for a “deposit certificate”.

Didn’t go well in court I’d used incorrect wording of the grounds on my Section 8 notice so had to give notice again, thats one for another discussion though :frowning:

I disagree. Its the same thing. The email you will have received as summarised above states deposit certificate, but its the prescribed information which is attached.

There is no seperate certificate or information in any other format downloadable from either Openrent or Mydeposits.

Ok, well thats different to TDS and DPS where the certificate is separate and only sent to the landlord once the deposit is cleared and registered.

Deposit cert and prescribed info are two different things on TDS @Karl11
