I want to give my two tenants’ notice. They have separate tenancies.
The first tenancy ends on 8th June 2025 and the 2nd on 19th June 2025.
Can I issue a Section 21 notice giving 2 months notice even though there is less than 2 months notice left on each tenancy to end after the fixed term finishes so giving them 2 months notice required or is it specifically linked to the rent due date (eg 9th or 20th and so wait another couple of weeks) - all the advice seems to be about if you want to end the tenancy within the fixed term and not beyond it.
I am hoping that the answer will be that I can give 2 months notice now to end after the fixed term .

Yes ….as long as s21 gives minimum 2 mths notice AND the notice to quit date is after completion of the fixed term.

As things stand, assuming you have a standard assured shorthold tenancy in place with no indication of what happens after the end of the tenancy, the tenancy reverts to a statutory periodic tenancy.
This is quite specific on how this works: Going Periodic: What Happens When a Tenancy’s Fixed Term Ends?, specifying the notice should end on the last date of a monthly renewal.
Obviously don’t know specifics of the situation and how linked these two tenants are, but assuming they would like to move out together, I would:
- talk to them first (if they’re going to trash the property, they have 2 months anyways - might as well try the human approach)
- serve s.21 notice on the correct dates, which is the LAST day of the rental periods
- agree the variation in writing to align them - effectively amend the rental date on the first agreement to 20th
All of this is subject to RRB and when that is passed, but can only deal with the law as it stands…
