Gutter clearing who's responsibility?

Hi there, using the OpenRent standard Short term tenancy agreement who’s responsibility is it to clear out the gutters of leaves etc.?

I have found the agreement 9.12 under tenants responsibility, we always have this issue, the tenants never cleans out the gutters, but it is quite clear under 9.12.

do you think regardless, that if a tenant cleans the gutters and has an accident, falls of the ladder that you might be in a bit of difficulty?

Especially if he’s hasn’t finished the job before the accident happens!

well then you evict him whilst he is strapped up in hospital or…get someone else to do the job and send the tenant the bill.

When it states tenants responsibility it doesn’t mean they physically have to do it. There are contractors. Suggest you give them a couple of suggested companies who undertake this role. When you do your inspections you could ask to see the invoice.

Alternatively if their responsibility you could have your man call to go the work and bill the tenant referring to the AST. This saves them the hassle and you know it’s done. Alternatively, increase the rent and include as landlord responsibly
