Landlord misery

Continuing the discussion from Difficult tenant:

I have a new tenant my letting agent moved into my property in August since then He has persistently paid rent 2-3 weeks late this month 2 weeks late . The letting agent unbeknown to me took no deposit . I found out when first month he was late with rent I then asked to see his referances they refused
I have been with this agency for 18 years when I have previously tried to move they refer to a primary tenancy agreement which I sighned 5 years ago when they were full managing agents . I have now moved to rent collection . They say the tenant is their tenant not mine so I have no rights at all

What does your agreement with estate agent read?

Is the estate agent registered with a property ombudsman

If so ask them for advice / mediation

Don’t take at face value what the estate agent is saying

At the end of the day it’s your property and the tenant is ultimately yours not their’s
If things went wrong it would be you having to deal with it

If the contract has unfair terms or terms now rules against in law it may be that the contract is void due to unfair terms under the CTA 2015
Eg fees in perpetuity are illegal

The estate agent should be registered with a property ombudsman .
They can mediate on your behalf or talk you through if the estate agent is talking detritus
