So my friend rented an apartment for the last 4 years. They now have a place of their own. They gave their notice to the landlord and since they were breaking the contract, they paid the early breakage amount as well.
However, now that the notice period has ended, the landlord is refusing to end the tenancy stating that he is unable to find new tenants. He wants my friend to pay the remainder of the months’ rents.
There are few damages to the property such as stained carpet, broken blinds. My friend is willing to let the landlord deduct the repair charges from the deposit but the landlord wont relent. He insists on my friend paying rent till the end of the contract period.
We need more detail. What the exact agreement with the landlord about breaking the contract? Was it conditional in any way? After the tenant served notice, was it acknowledged in any way by the landlord?
Normally if a tenant breaks a Tenancy ,they pay until a new tenant is found , but the LL does not have to agree!

The tenancy agreement is just like a contract of employment with a different header.
The contract is not fixed for life, so it can be broken and this will be backed up by an English court or the CJEU. Best bet, visit your local citizen advice bureaux.
Good . Your safest move is messages is thru openrent, so a better level of security. Tho not 100% so be careful, go thru the proper routine . You can check who owns a property thru the goverment Land Registry for just a few quid. Never pay before a viewing and pay thru OR if possible . Others have come unstuck.
OpenRent has called us for viewing many times but at the end of the viewing they give another person the house and this is so sad when you went for many viewing and later they didn’t give you the house…And we want the 2bedroom flat before 12th of this month October.

Getting rid of Section 21 is not Landlords fault and very seldom used, the fact that it was there was a deterrent in itself so didn’t need to use it and who wants to get rid of a customer.
It’s fake news it’s the Government / local Authorities that wanted rid of it to stop Tenants abusing the System and expecting the Council to house them with the benefit of Court Order.
It’s nonsense and what’s the between those people having to find another place to live and the millions of others that move all the time for any number of reasons and find another place.
The consequences have been to drive out hundreds of thousands of landlords unfairly, drive up rents by 30% so it’s hardly a Renters Rights Bill at all it has created Homelessness by Statute well done.
